To obtain a Marriage License in the State of Montana both applicants must appear in person before the Clerk of Court’s Office and complete the Marriage License application. Office hours are 9 a.m. to 5 p.m., we request that you come in before 4:30 p.m. to start an application.
License Requirements
- Applicants must bring with them:
- Photo ID
- Rubella Test or Waiver of Requirement for Blood Test
- Certified Copy of divorce decree (only if last marriage ended in divorce)
- If applicant is under the age of 18 please see Age Requirements
- $53 must be in cash for the license. We also have optional marriage license folders for an additional $1
Age Requirements
Applicants must be 18-years-old to apply for a marriage license in the State of Montana without the consent of parents or a legal guardian and a District Court Judge. If an applicant is under the age of 18 he or she must be at least 16-years-old. 16 and 17-year-olds must submit a letter from a designated counselor stating that the applicants have had at least 2 sessions of marriage counseling at least 10 days apart. This letter must be submitted upon application for a marriage license. Parents or Guardians must sign consent and judicial approval needs to be obtained in all underage applications.
Residency Requirements
If the applicants are residents of the county in which the license is obtained the license is valid throughout Montana. If the parties are non-residents the license may be used in the County through which the license was obtained.
Rubella Test
A Rubella test is required only for females under the age of 50, or you may complete a Waiver of Requirement for the Blood Test which is available at our office.
Those under 50 are exempt from the blood test. The Clerk’s Office requires that the pre-marital certificate be presented at the time of the application.
The Marriage License is valid for 180 days after it is issued.
